NOTICE: THIS IS A LEGALLY BINDING AGREEMENT.
By signing this agreement, you waive your right to bring any action to recover compensation or obtain remedy for any injury to yourself or your property or for your death however caused arising in any manner out of your participation in the Baby Name Game.ca Challenge (“Event”) now or any time in the future, whether caused by the negligence of Metroland Media Group Ltd, its parent or affiliates, or their respective officers, agents, and employees (together, referred to as “Releasees”) or otherwise
ACKNOWLEDGMENT OF RISK
I hereby acknowledge and agree that participating in the Event has inherent risks. I have full knowledge of the nature and extent of all the risks associated with participation in the Event, and have had any questions about the same explained to me, including but not limited to (a) all manner of injury resulting from participation in events held at The Living Arts Centre Bridal Show, including injury, including death, resulting from any form of negligence on the part of any of the Releasees; and (b) injuries or death resulting from any health factors, both known and unknown to the participant./p>
I further acknowledge that the above list is not inclusive of all possible risks associated with participation in the Event and that the above list in no way limits the extent or reach of this waiver and covenant not to sue. I understand that this acknowledgement and assumption of risk is binding on my heirs, executors, administrators and assigns.
WAIVER/RELEASE /INDEMNIFICATION AND COVENANT NOT TO SUE
In consideration of my participation in the Event, I agree to waive and release, and on behalf of myself, my heirs, representatives, executors, administrators and assigns, hereby do release the Releasees from, and WAIVE MY SUBSTANTIAL RIGHTS TO ASSERT, any cause of action, claims or demands of any nature whatsoever, including but not limited to, a claim of negligence, which I, my heirs, representatives, executors, administrators and assigns may now have, or may have in the future against any of the Releasees on account of personal injury, property damage, death or accident of any kind arising out of or in any way related to participation in the Event, whether that participation is supervised or unsupervised, and however the injury or damage is caused, including, but not limited to, the negligence of any of the Releasees
In consideration of my participation, I agree to INDEMNIFYAND HOLD HARMLESS the Releasees from any and all causes of action, claims, the Event, whether asserted by any of the Releasees or any third parties who may be injured or damaged on account of or in any way resulting from my participation.
I hereby certify that I have full knowledge of the nature and extent of the risks inherent in participating in the Event and that I am voluntarily assuming the risks. I agree that I will be solely responsible for any loss or damage, including death, I sustain while participating in the Event and that by this agreement, I am waiving any right to pursue the Releasees for any liability for such loss, damage or death, even if caused by genuine negligence.
AUTHORIZATION TO REPRODUCE PHYSICAL LIKENESS, BIOGRAPHICAL INFORMATION AND VOICE
I hereby grant to the Releasees, and to any third party they may authorize and to such third party’s employees, agents and assigns, the right to use my name and the right to photograph, film, tape and/or record and/or to use pictures, silhouettes and/or other reproductions of the same and/or the physical likeness of me (as the same may appear in any camera photograph and/or motion picture film), my supplied biography and/or recordings of my voice in connection with (i) the exhibition and/or broadcast, theatrically, on television and/or on radio, of any motion picture film and/or tape and/ or on the internet, which may be used or incorporated in connection with the Event; (ii) the publication in magazines, newspapers and/or otherwise, of any articles in connection with the Event; and/or (iii) the advertising, exploiting and/or publicizing of the Event in any motion pictures, television programs, radio programs, videos, magazines, newspapers, and/or other mediums.
GENERAL
I understand that the terms of this agreement are legally binding and I certify that I am signing this agreement, after having carefully read it, of my own free will.
